Relocation Law 101
for Businesses
Relocation laws are based on a set of laws often called the Uniform Relocation Act or URA. The URA REQUIRES that government units who force people and businesses to move pay substantial relocation benefits. The URA also REQUIRES the government to tell you what you are eligible to receive and to help you make a claim.
The reality is the government is usually good at helping you make a claim BUT where they fall short is telling you what you are eligible to receive. They know what you don’t know you don’t claim and you don’t get. Businesses are entitled to receive a wide range of assistance and payments and we often say a claim is like a tax return in that the claim is supported, and must be supported, by proper documentation. If the business does not know how to document their claim and fails to assert all eligible aspects of the business move they do not get paid for it. Seldom will the government simply negotiate business relocation costs without proper documentation. They simply say no to all request if not properly documented and asserted based on the relocation rules. Too often businesses and their attorneys settle business relocation claims for far less than what it should be.
The key is knowing all the claim rules and documenting the claim to get paid what the law requires.
