Relocation Law 101
for Homeowners and Rental Tenants

Questions You Need to Ask Yourself:

1. Is your City or other governmental entity acquiring your home through direct
purchase or through the use of the power of eminent domain?
2. Has a governmental entity acquired your home through direct purchase or through the use of the power of eminent domain?
3. Have you owned your own home for at least the past 180 days?
4. Have you owned your own home or rented a home or apartment for at least the past 90 days?

If you answered yes to any of these questions you may be entitled to receive relocation advisory services, assistance, payments and benefits from the government.

The next question you need to ask yourself is do you know the full amount of these relocation advisory services, assistance, payments and benefits for which you may be entitled?

The answer to that question is one with which very few homeowners or tenants are very familiar. In a nutshell, whenever the government acquires your property and you are forced to move, you are entitled to be compensated for the costs to acquire a new home or rent a new apartment, the costs to move you and your family to the new home or apartment, closing costs on the new home and other additional benefits.

While someone from the government may have spoken with you or had a relocation consultant speak with you; the reality is they rarely provide all of the relocation advisory services, assistance, benefits and payments for which displaced persons may be entitled. It may be worse in other cases. Many times the government will work with private developers in attempt to get around the law that requires them to provide these relocation advisory services, assistance and benefits.
